Generally speaking, the landlord’s responsibilities are to insure that the premises is habitable for your tenant. On the flip side, the tenant’s responsibilities are to maintain the property in the same condition as to how they found it upon the start of tenancy. The following are the specific responsibilities of both parties:
Landlord’s responsibilities
- Landlord shall provide reasonable waterproofing and weather protection of the premises;
- Shall maintain in good working order electrical, plumbing, heating, ventilating, cooling, or sanitary facilities supplied by the landlord;
- Not maintain the premises in a manner hazardous to the health or safety of the tenant; and
- Shall install working smoke detectors in the premises when the lease term starts.
Tenant’s responsibilities:
- The tenant shall comply with all obligations imposed upon tenants by applicable provisions of all municipal, county, and state codes, statutes, ordinances, and regulations;
- Keep the premises clean, sanitary, and in good condition;
- Notify the landlord immediately of any defects, maintenance issues, or dangerous conditions of which the tenant becomes aware;
- Be responsible for cleaning and routine maintenance;
- Dispose promptly of all rubbish, garbage, and other waste; and
- Properly use and operate any electrical, gas, and plumbing fixtures and keep them as clean and sanitary as their conditions permit.
